I. MEMBERSHIP
1.1 Initiation

of Initiation Fees: Initiation fees are due with application
for membership.
1.2

- Applicants
for membership to the club will include with that application
that amount equal to one calendar year's dues appropriate to
the class of membership applying for. There are no prorations
of dues in the application process.
1.3
Payment of Dues: Dues are payable in advance of the first day
of January in each calendar year. (Bylaws 6.3)
1.4
Notice of Delinquency: Procedure, A written notice of Delinquency
shall be mailed or otherwise delivered by the Club to the Delinquent
Member within ten (10) days after the member becomes delinquent.
As per Bylaws ARTICLE V, Paragraph 5.3, and any other indebtedness
within thirty (30) days after notice without further notice or action
by the Board of Directors, unless the Delinquent Member shall have,
in writing, made arrangements to pay all indebtedness in a manner
acceptable to the Board of Directors.
1.5
Posting: Procedure, Provided the notice of Delinquency has been
given in accordance with ARTICLE V, Paragraph 5.3 of the Bylaws
and in accordance with Rules and Regulations section 1.4, herein,
and provided that the Delinquent Member has not paid the account
in full within ten (10) days of the delivery of the Delinquent notice,
then the Delinquent Member's name shall be posted and the member
may not incur any further indebtedness to the Club.
1.6
Late Charges: In accordance with the powers conferred upon the
Board of Directors, under ARTICLE X of the Bylaws, the Board of
Directors may add a late charge penalty to that Reinstated Member,
ARTICLE IX, Paragraph 9.1, who was Terminated for Failure to Pay,
ARTICLE V, Paragraph 5.3, in the same calendar year. The late charge
penalty shall be twenty dollars ($20.00) per 30 day period beginning
at the end of 30 days following the dues billing date of that calendar
year that the member was delinquent and terminated through the 30
day period that the member was reinstated. Late Charge Penalty shall
not be levied beyond December of the same calendar year, after which
time, ARTICLE IX, Paragraph 9.1 of the Bylaws shall expressly apply.
1.7
Transferring Members Dues: The appropriate new dues, accorded
to the new class of membership, to which the Member is transferring,
will be due and payable upon receipt of the yearly dues bill for
the January 1December 31 calendar year following the transfer.
1.8
Penalty for Failure to Request Transfer Between Classes When Required:
The burden is on a Member to request a transfer to an appropriate
class in the event of non-eligibility to remain in the existing
class of membership. In the event the member neglects to request
a transfer at an appropriate time, but later does so, the Member
will be chargeable with dues as required of the class into which
transferred effective on the date when transfer should have occurred.
1.9
Family Guest Cards: The privilege of requesting guest cards
for family members of a Club member, is limited to Regular, Honorary,
Non-Resident, Junior, and Staff Commodore. A Family Guest Card may
be issued by the Club Manager on duty or by a designated Club Employee.
Without specific approval of the Board of Directors, a Family Guest
Card shall not be issued by the Manager or other employee for a
period exceeding fifteen consecutive days, or a combination of days
exceeding fifteen days within any period of six successive months.
The Manager of the Club shall maintain a book showing the names,
addresses, relationship to Tahoe Yacht Club Member, the name of
the Club employee or officer approving the issuance, and Club Member
sponsoring that Family Member Guest.
The
Family Guest Card is a courtesy and privilege bestowed by the Board
of Directors and not a right of membership to those above qualified
Tahoe Yacht Club Members who on special occasions may not be available
to accompany a family member to the Clubhouse or Club activity
A Family
Guest Card can be terminated at any time by the Board, on its own
initiative, without notice, and without appeal.
1.10
Honorary Guest Card: An Honorary Guest Card may be bestowed
upon that person described in ARTICLE II, Paragraph 2.6, of the
Bylaws, at the initiation of either the Commodore, the Membership
Committee, or the Board itself. In whichever case of initiation,
there shall be agreement in purpose by the above parties and an
eventual unanimous confirmation vote by the Board giving this Honorary
Guest membership great meaning. This Honorary Guest Card shall be
valid until the final Board meeting of the fiscal year at which
time the membership and card is renewed by unanimous vote or rejected
for renewal by two "NO" votes. The General Manager of the Club shall
maintain a book showing the names and dates of all Honorary Guest
Members. The Honorary Guest Member shall pay no fees. A letter of
notification to the recipient of the Honorary Guest Card shall come
from the Commodore with appropriate welcoming remarks.
The
Honorary Guest Card can be terminated at any time in the fiscal
year by the Board, on its own initiative, without notice, and without
appeal.
1.11
Complementary Guest Card: A Complementary Guest Card may be
issued to a deserving peripherally involved service/business oriented
person who has performed valued and appreciated tasks for the Club.
A Complementary Guest Card may be proposed by the Club General Manager,
the Commodore, or the Membership Committee. In whichever case of
proposal, there shall be agreement in purpose by the above three
parties before issuance of the Card. This Complementary Guest Card
shall be valid until the final Board Meeting of the fiscal year
at which time the General Manager, the Commodore and the Membership
Committee will at a casual moment, before or after the Board meeting,
deliberate renewal of all outstanding Complementary Guest Cards
for the next fiscal year. The General Manager will maintain a book
showing the names and dates of all Complementary Guest Members.
Complementary Guest Members shall pay no fees, have no voting privileges,
enjoy no reciprocity, and not sponsor or second applicants for membership.
A Complementary
Membership can be terminated at any time in the fiscal year by the
Board, on its own initiative, without notice, and without appeal.
1.12
Interim Guest Card: An Interim Guest Card may be issued by the
General Manager, or by direction of the General Manager, to an applicant
for membership who has submitted his completed application as per
Paragraph 1.15 of these Rules and Regulations. The Interim Guest
Card shall be dated to expire on the day of the next Business Meeting
of the Board of Directors. The General Manager shall maintain a
book showing the names and dates of all Interim Guest Cardholders.
The Interim Guest Card Holder shall enjoy the privileges of membership
in the Tahoe Yacht Club, for the prescribed period of time, but
shall have no voting privileges, enjoy no reciprocity, and not sponsor
or second applicants for membership. The Interim Guest Card is a
courtesy and privilege bestowed by the Board of Directors and is
not to be construed to be a message or handshake, or signal of impending
membership in the Club.
An
Interim Guest Card can be terminated at any time by the Board, on
its own initiative, without notice, and without appeal.
1.13
Reciprocal Guest Card: A Reciprocal Guest Card may be issued
by the Club Manager on Duty or by a designated club employee to
a visitor who will verify membership in a Yacht Club that shares
reciprocity with Tahoe Yacht Club. The Reciprocal Guest Card, good
for one day's visit, will be issued no more than 15 times in a calendar
year to the same qualified guest. If the reciprocal guest’s
primary residence or sponsoring Yacht Club is located within a 50
mile radius of the Tahoe Yacht Club, visits are limited to a maximum
of 5 times per calendar year. The Manager of the Club shall
maintain a book showing the name, Yacht Club affiliation, and date.
The Board of Directors reserves the right to modify at any time
in general terms or on an individual basis these guidelines.
1.14
Transferring Initiation Fee: Only the class of Non-Resident
Member shall pay a Transferring Initiation Fee when transfer is
made from Non-Resident to another class. The Transferring Initiation
fee, shall be the dollar amount difference of the class to which
transfer is being made less the Non-Resident Initiation Fee already
paid. There will not be a refund of initiation fee money to any
Club Member transferring into a class with a lesser initiation fee
than that fee in the class from which they are transferring. The
Transferring Initiation Fee is due and payable at time of transfer.
1.15
Application for Membership, Procedure: Any Regular, Honorary,
or Staff Commodore member, having been a member of the Club for
one year, may request, as Sponsor, an Application for Membership
from the club office on behalf of an applicant. A Non-Resident Member,
with one year's membership, may request an Application for Membership
only for a Non-Resident applicant. The applicant will answer the
application completely, the Sponsor, as described above, will address
the Membership Committee, in letter form, in the space provided
on the Application for Membership. All Applications for Membership
shall have also a Seconder, who will also address the Membership
Committee, in letter form in the space provided on the Application
for Membership. The Sponsor and the Seconder, will in their letters
explain their relationships to the applicant and highlight the potential
contribution the new member will bring to the Club. Applicant's
cash or check equal to the full amount of combined initiation fee
and first year's dues, appropriate to the class of membership being
applied to, shall accompany the completed Application for Membership
to the Club Offices to be logged, date stamped and issued for process.
The Club Board of Directors, in most instances, at its next regular
meeting, will consider new applicants for membership to the Tahoe
Yacht Club.
The
Membership Committee is charged, by the Board of Directors, to make
recommendation for or against membership for each individual applicant.
Further, that the Applicant, Sponsor, and Seconder understand that
any prospective member is evaluated on their own merits, the recommendations
from the Sponsor and Seconder, comments from the members and possibly
comments from the general public. Further, that the Membership Committee
will provide the Prospective Member, Sponsor, and Seconder with
the result of the Board's decision without explanation or comment.
1.16
Posting Applications for Membership: Every application for membership
that is completed and in compliance with Paragraph 1.15 of these
rules and regulations shall be posted as follows:
- In a very
visible and accessible area of the Clubhouse.
- On Membership
web page of the Tahoe Yacht Club internet website (www.TAHOEYC.com).
This posting will include name/names, city of residence, class
to which applying, occupation, sponsor and seconder. If Committee
receives a negative comment from a member in good standing regarding
a new application, then Membership Committee will arrange and
have an interview with that applicant before sending that application
to the Board for election.
It
is expected that all members of the Tahoe Yacht Club will routinely
inspect the Postings and immediately report to the Membership Committee
their objection to elect the Applicant to membership. Absent of
any objections during the period of Posting, the applicant must
still be elected to membership by the Board of Directors as per
ARTICLE III, Paragraph 3.4 of the Bylaws. And, understand that an
objection to the application does not automatically disallow election
to membership.
1.17
General Manager Membership: At an appropriate time, the Board
of Directors may elect, by unanimous vote, to invite the General
Manager of the Club to become a Regular Member of the Club, as per
Article 2.3 of the Bylaws. If the so elected General Manager accepts
membership, he will receive and enjoy all rights and privileges
accorded to
a Regular Member
in the Bylaws, and he will abide by all Rules and Regulations and
Bylaws with the following exceptions:
a. The
General Manager shall pay no dues or initiation fees.
b. Term
of membership shall continue until terminated as provided in the
Bylaws. Term of membership shall also, in this special case, be
terminated with no further notice or action by the board at the
time above said General Manager ceases to be employee of the Club.
c. At an
appropriate time, before the next board meeting after leaving the
employment of the Club, the person here so designated as the ex-General
Manager, may apply by letter to the Board to become a Regular Member
in the Club. If unanimously approved for Regular Membership by the
Board, initiation fees shall be waived, and appropriate annual Club
dues will be levied and due on the next January 1 due date. Annual
Club dues shall be levied, appropriate to the member class, thereafter.

1.18
Class Transfer: A two-person couple membership will progress
to the next level of membership when either person of the couple
attains the age that triggers that progression. i.e.: 36th birthday
for young-adult-regular to regular membership and 22nd birthday
for junior to young-adult-regular membership. The exception to the
junior to young-adult-regular move is, as per Bylaws 2.7, if either
party is still a full time student. (Jan. 31, 1998)
1.19
Vote: Every membership in good standing has one vote. The junior
class of membership has no voting privileges. A one-person membership
has one vote, and a two-person/couple membership has one vote. (Jan.

1.20
Application to Membership to the Club by a TYC Employee: Excepting
that provision in Section 1.17 of Rules and Regs, henceforth this
date, July 25, 1999, it shall be the policy of the Board of Directors
to set aside for consideration any application for membership by
any TYC employee until such time that employee ceases to be an employee
of the Club. Further, henceforth, this date July 25, 1999, any applicant
for employment by the Club, who is also a member of the Club, will
agree to sign onto inactive membership for the duration of his/her
employment. (July 25, 1999)
1.21
Inactive status is entitled only to TYC members who become new
hires to the Club employee roster. There will be no dues and no
Club privileges for the duration of the Inactive status. When the
employee/inactive member leaves, in good standing, the employ of
the Club, he/she will be credited back the unused time and paid
dues accumulated at the time of employment and inactivation to the
new remaining year dues payable at time of reactivation of TYC membership.
The transition from Inactive membership to the appropriate class
of full membership will not be automatic, but by Board action. (July
